Finjan Provides Litigation Update -- Favorable Rulings on Motions for Summary Judgment Entered in Blue Coat Case
EAST PALO ALTO, CA -- (Marketwired) -- 06/04/15 -- Finjan Holdings, Inc. (NASDAQ: FNJN), a cybersecurity company, and its subsidiary Finjan, Inc. are pleased to announce that the Honorable Beth Labson Freeman issued summary judgment rulings in Finjan's patent infringement case against Blue Coat Systems, Inc. (5:13-cv-03999-BLF). Finjan will be proceeding to trial on July 20, 2015, maintaining its assertion of claims from each of the six patents against Blue Coat that were in its original complaint.

Those efforts have been largely given short shrift, forcing us down a litigation path. The hearing on the parties' summary judgment motions was held on April 16, 2015. Blue Coat filed a motion for summary adjudication of non-infringement on the six patents asserted against Blue Coat. Except with respect to a single asserted claim in which Blue Coat sought a ruling that it was indefinite, Blue Coat did not challenge the validity of any other of Finjan's asserted patents and claims in its summary judgment motion. With its motion, Blue Coat was seeking judgment that it did not infringe Finjan's U.S. Patent Nos. 6,804,780; 6,154,844; 7,418,731; 6,965,968; 7,058,822 and 7,647,633. The Court's Order is currently filed under seal and will be released pending the parties' submission of proposed redactions, if any, of highly confidential and business sensitive information by no later than June 8, 2015, (Docket No. 257).
A summary judgment (or Judgment as a Matter Of Law or JMOL) is a judgment entered by a court without full trial, and may be directed to the merits of an entire case, or on discrete issues in that case.
Finjan also filed patent infringement lawsuits against FireEye, Proofpoint, Sophos, Symantec, and Palo Alto Networks relating to, collectively, more than 20 patents in the Finjan portfolio. The court dockets for the foregoing cases are publicly available on the Public Access to Court Electronic Records (PACER) website, www.pacer.gov, which is operated by the Administrative Office of the U.S. Courts.
